Critical Analysis of the Department of Health’s Circular 6, which regulates involuntary hospitalization in psychiatry

Abstract

Objective: this article reviews the ‘Circular Number 6 of Santiago, December 21, 2021, which instructs on involuntary hospitalization of people affected by mental illnesses, leaving the circular that indicates without effect’. Method: the clinical and legal complexity of involuntary hospitalization are considered when reviewing the Sections of the Circular. Results and Conclusion: Circular 6 urgently requires either modifications or being replaced by a new one, the preparation of which must gather the knowledge and experience of representatives from various State institutions, experts by experience and their families, and civil society, maintaining a clear focus on the protection of the human rights of those being involuntarily detained.
