Analysis, from critical linguistics, of law N° 20.584

This research aims to characterize discursive strategies that establish the category “person” as a subject of rights and duties in Law N° 20.584. The methodological approach used was the discourse analysis from linguistic criticism, and analysis tools proposed by Roger Fowler were applied. Through this, it was possible to see that the rights that the text regulated are not attributes of patients because these are conditioned to healthcare providers fulfilling their duties. Therefore, it is possible to assert that Law N° 20.584 does not generate the practical effect of granting patient’s rights. Moreover, patients appear as passive recipients of action.
